We are committed to protecting your privacy and, for that reason, we have adopted this Privacy Policy to explain our data collection, use, security, and disclosure practices through BoogieBoard’s products and services, including those at https://www.boogieboard.ai, https://www.app.boogieboard.ai, and any other websites, mobile applications, products, and services provided by BoogieBoard that link to or reference this Privacy Policy (collectively, the “Services”). The Services are owned and operated by BoogieBoard LLC (“BoogieBoard”, “we”, “us” or “our”). By accessing or using the Services, you consent to this Privacy Policy. If you do not agree with this Privacy Policy, please do not access or use any part of the Services.

1. Privacy Policy Applicability

This Privacy Policy applies to information BoogieBoard collects through the Services, as well as other information provided to us online or offline by third parties when we associate that information with customers or users of the Services (but not to information collected from our employees, contractors, or vendors). This includes Personal Information that can identify or relates to you, including but not limited to your first and last name, telephone number, Internet Protocol (IP) address, postal, and email addresses (“Personal Information”). You have the choice on what information to share and the services you want to engage. You can choose not to provide information to us, but in general, some information about you is required in order for you to access certain functionality of the Services. If you do not consent to this Privacy Policy for any reason, please do not use the Services or share your information with us. Please note that this Privacy Policy applies only to the Services, and not to any other third-party website linked to or from it, or any third-party website in which BoogieBoard content or functionality is embedded. We do not control the privacy policies or practices of others. Accordingly, we encourage you to review the privacy and security policies and terms of service of those third parties so that you understand how those websites collect, use, share and protect your information.

We may modify or update this Privacy Policy periodically with or without prior notice by posting the updated policy on this page or within the Services, or by emailing you. You can always check the “Last Updated” date at the top of this document to see when the Privacy Policy was last changed. We encourage you to check this Privacy Policy from time to time.

By using the Services, you consent to the processing of your Personal Information as described in this Privacy Policy, including the transfer, use, and storage of your personal data in the United States. You may withdraw your consent at any time by following the instructions in the Accessing Your Personal Information section below, but this will not affect the lawfulness of processing based on consent before its withdrawal. You have the right to file a complaint relating to the processing of Personal Data with any relevant data protection authority.

2. Accessing Your Personal Information

To the extent provided by the law of your jurisdiction, you may (a) have the right to access certain Personal Information we maintain about you, (b) request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes, (c) request that we update or correct inaccuracies in Personal Information, (d) object to our use of your Personal Information, (e) ask us to block or delete your Personal Information from our database, and (f) request to download the Personal Information you have shared on the Services. Any such requests are subject to the protection of other individuals’ rights and applicable law. Additionally, to help protect your privacy and maintain security, we may take steps to verify your identity before granting you access to the information. In some cases, we may need to retain your Personal Information for legal reasons or for legitimate business purposes, as permitted by applicable law.

We may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others, would be extremely impractical (for instance, requests concerning information residing on backups), or relate to information that is not associated with your Personal Information. As described in Section 4(A) above, we also intend to implement account settings that will give you a greater degree of control over certain type(s) of disclosures of your Personal Information.

3. Collection of Information

During your use of the Services, BoogieBoard collects information in various ways, including:

Directly from you when you provide it to us; and

Automatically as you use the Services.

3.1. Information You Provide to Us

Account Creation: When you create an account or otherwise use the Services, we collect information such as your name, email address, password, role within your team or enterprise, and an optional profile photo.

Your Communications with Us: We collect information from you such as email address, phone number, or mailing address when you request information about our Services, register for our newsletter, request customer or technical support, or otherwise communicate with us. We also collect the contents of messages or attachments that you may send to us, as well as other information you choose to provide, and that may be associated with your communications.

Payment Information: When you purchase a subscription to the Services, you will need to provide payment information (e.g., financial account details, shipping information) to process your subscription. We use third-party payment providers to process payments on the Services. We may receive information associated with your payment information, such as billing address and transaction information, but we do not directly store payment information on the Services. Payment information is stored and processed by our payment providers on our behalf.

Surveys: We may contact you to participate in surveys. If you decide to participate, you may be asked to provide certain information which may include contact information and other information about you.

Interactive Features: We may offer interactive features such as forums, blogs, chat and messaging services, and social media pages. We and others who use our Website or Services may collect the information you submit or make available through these interactive features. Any content you provide via the public sections of these features will be considered “public” and is not subject to the privacy protections referenced herein. By using these interactive features, you understand that the information provided by you may be viewed and used by third parties for their own purposes.

Registration for Sweepstakes or Contests: We may run sweepstakes and contests. Contact information you provide may be used to inform you about the sweepstakes or contest and for other promotional, marketing and business purposes.

Conferences, Trade Shows, and Other Events: We may attend conferences, trade shows, and other events where we collect contact information from individuals who interact with or express an interest in the Services.

Job Applications. We may post job openings and opportunities on the Website or Services. If you reply to one of these postings by submitting your application, CV and/or cover letter to us, we will collect and use your information to assess your qualifications.

3.2. Information Automatically Collected by the Services

BoogieBoard and third-party service providers may automatically collect information about you when you use the Site. Like many other websites or apps, BoogieBoard and its providers may collect and store information that is generated automatically as you navigate through the Site. This information is primarily needed to maintain the security and operation of the Site, and for our internal analytics so that we can improve the Site. This information includes:

Internet and Electronic Activity Data, including cookies, details of your visits to the Site, including traffic data, generalized location data, logs, and other communication data and the resources that you access and use on the Site, device's unique device identifier, operating system, browser type, mobile network information, device's telephone number, browsing history, browser and device information, advertising identifiers, clickstreams, search history, usage details, IP address, pixel tags, browser version, operating system, other tracking technologies.

Cookies, are small data files that we transfer to your computer’s hard disk for record-keeping purposes. Cookies do not personally identify you; they merely identify the computer or device with which you access the Site. The Site use cookies to analyze trends, recognize you, tailor the Site to you, or to detect and prevent fraud. You can instruct your browser, by changing its options, to disable cookies or to prompt you before accepting a cookie from the Site. If you disable cookies, however, you may not be able to use all portions or functionality of the Site.

Third Party Cookies

Google Analytics, we use Google Analytics on the Site to help us analyze the traffic on the Site. Odoo, we use Odoo to assist with analytics of the Site. Odoo will set cookies for tracking visitors. It contains the domain, initial timestamp (first visit), last timestamp (last visit), current timestamp (this visit), and session number (increments for each subsequent session). 4. Use of Your Information

4.1 Processing

We process your Personal Information with your consent or as needed to provide you Services. We may also use your Personal Information to comply with legal obligations, operate our business, protect the vital interests of you, our customers, or the public, or for other legitimate business interests of BoogieBoard as described in this Privacy Policy.

More specifically, we may use the information we collect to:

  • Assist us in providing, maintaining, and protecting the Services.
  • Set up, maintain, and protect accounts on the Services.
  • Improve our online operations.
  • Process transactions.
  • Provide customer service.
  • Communicate with you, such as provide you with account or transaction related communications, or other newsletters, RSS feeds, or communications relating to the Services.
  • Send or display offers and other sales and marketing that is customized to your interests or preferences.
  • Perform research and analysis aimed at improving our products and services and developing new products, services or functionality, for example, we may use de-identified and aggregated data, including usage, behavior and compensation data, to create future functionality through machine learning.
  • Manage and maintain the systems that provide the Services.

4.2 Messages

In connection with your use of the Services, we may send you service announcements, administrative messages, and other information. You can opt out of receiving such e-mails or marketing from us by clicking on the “unsubscribe” link in the e-mails. Please note that it may take up to ten (10) business days for your opt-out request to be processed. Also, even if you opt out of marketing e-mails, we may continue to send you certain account-related e-mails, such as notices about your account and information regarding your transactions with BoogieBoard.

5. Disclosure of Your Information

5.1 Disclosures to Other Users of the Services

BoogieBoard may implement certain features and functionalities of the Services that may make your information, including certain categories of your Personal Information, visible and searchable to, and usable by, other users of the Services, such as users who are salespersons, recruiters, or employers (including, without limitation, your current employer); provided, however, that such Personal Information will be aggregated with information from other users or de-identified in a manner that does not allow such data about you to be separated from the aggregate data and identified as originating from you, to such third parties. When BoogieBoard implements these types of features and functionalities, we will (a) notify you and give you more detail about the ways that your Personal Information will be disclosed and otherwise impacted, and (b) modify the options in the Services account settings so that you will control what type(s) of your Personal Information will be made available, and to which type(s) of users your Personal Information will be made available. We may also share your information with our affiliates and business partners in order to further develop, improve, and provide the Services, as well as develop new products and services.

5.2 Why does BoogieBoard need to make these types of disclosures?

BoogieBoard makes these disclosures to other users of the Services in order to continue offering the Services at no cost to you, and to otherwise support our business model. In other words, we think there’s a really great opportunity to help find, organize, and share data that has been inherently difficult to show most sales organizations. There are also significant benefits to you that result from these disclosures: (a) your employer (i.e. your manager) will easily and quickly be able to see your sales information, which may allow you to be recognized for your performance in a particular month or quarter, and (b) we will be able to continually improve and upgrade the Services, and in many cases offer such upgrades and enhancements at no cost to you.

5.3 Other Disclosures

We may disclose Personal Information to provide the Services, or when you authorize or instruct us to do so, for example when you use the Services to submit content or profile information. We may also disclose Personal Information and other information to companies, agents, contractors, service providers, or others engaged to perform functions on our behalf (such as processing of payments, provision of data storage, hosting of our website, marketing of our products and services, conducting audits, and performing web analytics). We may license third party software to include in or use with the Services, in which case we may disclose Personal Information to the licensor.

We may disclose Personal Information to other third parties upon your consent to such disclosures. For example, we may need to share your Personal Information with a payment processing partner (e.g., Stripe) to allow for direct payment through the Services. We may also disclose your Personal Information to third parties when we believe, in good faith and in our sole discretion, that such disclosure is reasonably necessary to (a) enforce or apply the terms and conditions of the Services, including investigation of potential violations thereof, (b) comply with legal or regulatory requirements or an enforceable governmental request, (c) protect the rights, property or safety of us, our users or other third parties, (d) prevent a crime or protect national security, or (e) detect, prevent or otherwise address fraud, security or technical issues. Finally, we reserve the right to transfer information (including your Personal Information) to a third party in the event of a sale, merger, or transfer of all or substantially all of the assets of our company relating to the Services, or in the unlikely event of a bankruptcy, liquidation, or receivership of our business. We will use commercially reasonable efforts to notify you of such transfer, for example via e-mail or by posting notice on the Services.

5.4 Disclosure and Use of Aggregated Data

We may publish, share, distribute, or disclose to third parties Personal Information that has been aggregated with information from other users or otherwise de-identified in a manner that does not allow such data about you or your users to be separated from the aggregate data and identified as originating from you, including analytics, statistics, or other data related to your use of the Services (“Usage Data”). The Usage Data we collect includes how you interact with the Services, information generally collected or “logged” by Internet websites or Internet services when accessed or used by users, and information about your web browser or device accessing or using the Services. Such information may help BoogieBoard identify and analyze training, demographic, and psychographic trends and information, and report to third parties how many people saw, visited, or clicked on certain content, areas of the Services, ads, or other materials. We may also use such data for research purposes as set forth above.

5.5 Personal Information You Post in Public Areas

When you post a message in a BoogieBoard forum, chat room, review, or customer feedback, the information you post may be accessible to other users of the Services and the public. If you post Personal Information anywhere on the Services that is accessible to other users or the public, you are advised that such Personal Information can be read, collected, used, or disseminated by others and could be used to send you unsolicited information or for other purposes. Accordingly, you assume full responsibility for posting such information and agree that BoogieBoard is not responsible in any way for Personal Information you choose to post in these public areas.

6. Information Security

BoogieBoard takes technological and organizational measures to protect your Personal Information against loss, theft, and unauthorized access, use, disclosure or modification. However, no data transmission over the Internet and no method of data storage can be guaranteed to be 100% secure. Therefore, while we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its security. We utilize reasonable information security measures to safeguard your Personal Information against unauthorized access, modification, or destruction, for example:

We use firewalls to help prevent external access into our network.

We use Secure Socket Layer (SSL), Transport Layer Security (TLS), or similar encryption technology to protect sensitive data at rest on databases and backups, and while in transit across web connections.

All data is stored in a cloud-hosted, password-protected database.

For some cloud-hosted databases, we rely on providers’ (e.g.Google Cloud’s) security programs to protect Personal Information while stored in their respective controlled facilities. We restrict access to Personal Information to our employees, contractors, and agents who need to know that information in order to operate, develop, improve or support our Services. If we share Personal Information with service providers, we require that they also use reasonable information security measures to safeguard your Personal Information and only use your Personal Information for the purposes for which we share it with them. BoogieBoard will retain your information only as long as necessary for the purposes outlined in this Privacy Policy and for a commercially reasonable time thereafter for backup, archival, fraud prevention or detection or audit purposes, or as otherwise required by law. BoogieBoard complies with applicable data protection laws, including applicable security breach notification requirements.

7. Additional Privacy Information

7.1 Data Transfer

By sending us your information, you further consent to its storage within the United States. Information gathered through the Services may be transferred, used, and stored in the United States or in other countries where our service providers or we are located.

If you use the Services, you agree to the transfer, use, and storage of your Personal Information in those countries. The data protection and other laws of the United States and other countries might not be as comprehensive as those in your country. You agree that all transactions relating to the Services or BoogieBoard are deemed to occur in the United States, where our servers are located. You are solely responsible for complying with all local laws, rules and regulations regarding online conduct and access to the Services.

7.2 Children

The Services are not intended for users under 13 years of age. We do not knowingly collect Personal Information from users under 13 years of age or authorize users under 13 years of age to use the Services. You may not use the Services or provide any Personal Information to BoogieBoard if you are under the age of 13 or if you are not old enough to consent to the processing of your Personal Information in your country.

7.3 Your California Privacy Rights

California Civil Code Section 1798.83 permits our customers who are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. 7.4 Your European Privacy Rights

Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (the “GDPR”) may also afford European citizens with the right to request information regarding the collection, retention, transfer, and deletion of their Personal Information. 7.5 Google API Data Policy

BoogieBoard’s use and transfer to any other app of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.
